Chapter 7

A Chapter 7 proceeding is a liquidation where the Court appointed Trustee evaluates all of your assets and sells any assets which are not exempt.  Thus, working to help you understand the favorable Indiana exemptions available to individuals is crucial in the process of considering whether Chapter 7 is the right option for you.

Depending on your eligibility, you can receive a completely fresh start. After the bankruptcy is discharged the only debts you owe will be for secured assets on which you choose to sign a “Reaffirmation Agreement.”

You’ll have immediate protection against creditor’s collection efforts and wage garnishments.

Wages you earn and property you acquire (except for inheritances) after the bankruptcy filing date are yours to enable you to move on with your life.

Your case is often over and completely discharged in approximately 3-6 months.

Foreclosure

Chapter 7 bankruptcy filing can provide you with powerful options when facing a home foreclosure.  Although Chapter 7 does not have a mechanism to re-establish payments or payback the arrears, Chapter 7 can delay the foreclosure process which would give you time to get a loan modification or work some other solution out with the mortgage company.
